This page chronicles Vodacom’s fraud perpetrated against me and its attempts to steal my money by attempting to raid my bank account with fraudulent debit orders.

I intend to create a pressure group with a view of launching a class action against Vodacom for recovery of millions of rand that it fraudulently extorted (and still extorts as I pen these words) from its hapless customers by way of fraudulent consumption figures. Vodacom's refusal to comply with our contract

My Vodacom nightmare is truly a saga and I will therefore deal with Vodacom’s mischief bit by bit. I entered into a contract with Vodacom in terms of which I was i.a. to receive Office 2007 on a 60 days trial. To activate the program I needed product keys but despite a vast number of telephone calls I never received it. I was told by the Vodacom representative that he was informed by Microsoft that I need to download the information from the Internet, but he was unable to tell me where I can find the information. He could also not tell me who he spoke to at Microsoft. I phoned Microsoft and I was informed by a member of its Response Management Team that Vodacom made a misrepresentation to me. He also told me that there have been a number of other people who also became victims of the same Vodacom shenanigans. I spent 8 days on my attempts to get what I am entitled to in terms of my contract with Vodacom and finally gave up after I made it clear that I will set of the damages that I had sustained against payments that I am obliged to make to Vodacom. Despite my concerted efforts I have been uncable to get Vodacom to contact me to resolve this issue and my other problems.

Vodacom’s failed high jinks

The contract referred to in my complaint, “Vodacom's refusal to comply with our contract” i.a. included a laptop and a 500meg data bundle. When the first payment was nearly due I phoned accounts who said that an amount of R638.99 is due. I said that I do not wish a debit order to apply to the matter since I will be paying Vodacom directly. When I tried to do an Internet transfer I had no success and even after several calls to customer care at Vodacom and their attempts to resolve the problem, we had no success. A consultant then advised me to make a payment at Standard Bank by going to the teller and doing a M65 Credit Transfer. That did not work and I spent 52 minutes at the teller speaking to a plethora of Vodacom personnel who gave me conflicting VSPC account numbers. I then asked the teller to do a search for Vodacom accounts with Standard Bank and deposited R640 into an account and gave the Vodacom crony who I was still on the line particulars about the deposit. But thereafter my bank informing me that an attempt had been made by Vodacom to extort an amount of close to R1000 from my account by way of a 'debit order'. I never authorised such a debit order! Vodacom’s high jinks fail again!

In my complaint, “Vodacom’s failed high jinks”, I mentioned that I paid R640 to Vodacom, which was slightly more than the amount that was due for the first month, but that Vodacom thereafter attempted (but failed) to extract an amount of close to R1000 from my account by way of a 'debit order' that I never authorised. When Vodacom did not succeed in its illegal shenanigans, it simply locked my account and I had to incur unnecessary expenses to be able to connect. The same type of thing happened the following month. As was the case with the 1st month, when I did not receive an invoice, I phoned Vodacom and was told that an amount of R631.07 is payable, which I paid in cash on the due date. But thereafter Vodacom once more attempted to raid my bank account with an amount far in excess of what I had to pay, and that I did indeed pay in cash. And Vodacom once more did so with a “debit order” that I did not authorise. The Police and the National Prosecuting Authority loom on the horizon! But Vodacom will shamelessly try its luck a third time, to no avail. And the chimera of the Police and the National Prosecuting Authority is about to become a harsh reality. So, watch this space!

Vodacom's pranks and the Police.

In my complaints, “Vodacom’s failed high jinks” and “Vodacom’s high jinks fail again!” I mentioned that I paid Vodacom at least what was due for the 1st and 2nd month and on both occasions Vodacom thereafter attempted (but failed) to illegally raid (with “debit orders” that I did not authorise) my bank account with amounts far in excess of what I had to pay, and that I did indeed pay in cash. Thereafter Vodacom took a third bite at the cherry. As was the case with the 1st and 2nd month I did not receive an invoice for the 3rd month and when I phoned Vodacom I was told that an amount of R589.58 is payable. I subsequently paid R590 to Vodacom in cash, and true to form, as was the case with the previous months, Vodacom once more attempted (and failed) to illegally raid my bank account with an amount far in excess of what I had to pay, and had already paid. In due course Vodacom made further attempts to extract money from my bank account with illegal debit orders, one of which was for an amount of R1816.33. In my next report I will deal with the reason why I have not yet taken positive steps to report this matter to the Police and the National Prosecuting authority. Watch this space!!

VODACOM'S SHENANIGANS CONTINUE

In my previous reports I related the following bizarre conduct of Vodacom: 1. Arrogantly breaching our contract by failing to deliver product keys, and persisted with the breach. 2. Attempting to raid my bank account, three months in a row, with illegal debit orders, after I had paid (in cash) the amount that Vodacom told me is due for each month. 3. Illegally locking my account which caused me to be unable to use data bundles for which I had paid. I also said that the Police and National prosecuting Authority now need to deal with the matter. When it became clear to me that I am not going be able use the data bundles that I have paid for and, would be paying for in the future, unless I pay money to Vodacom that I do not owe it, I suggested that our contract be be amended in that data bundles be excluded and that I pay for the laptop after we had negotiated a settlement of the amount that Vodacom owes me i.a. due to its breach of contract and debit order shenanigans. Not only was there no response to my proposal but, on the contrary, I received regular phone calls hounding me for money. Are they psychotic?The Police need to enter the fray.

VODACOM IS HEADING FOR A FALL

In my previous reports I mentioned how Vodacom attempted to raid my bank account, three months in a row with illegal debit orders after I had paid (in cash) the amount that Vodacom told me is due for each month. In my report “11:02 Mon 6 Apr” I stated that when it became clear to me that I am not going be able to use the data bundles that I had paid for and, would be paying for in the future, unless I pay money to VODACOM that I do not owe it, I suggested that our contract be amended in that data bundles be excluded and that I pay for the laptop after we had negotiated a settlement of the amount that VODACOM owes me, i.a. due to its breach of contract and debit order shenanigans. In that regard I need to add that, in order to remain the Knight in Shining Armour in my spat with VODACOM, and to preserve my good faith, I offered to make regular future payments on the laptop, without prejudice to my claim against VODACOM, as soon as my proposal had been accepted; and that I would do so, even before consensus had been reached on the amount of the credit that VODACOM should agree upon due to its illegal mischief, and while negotiations continue. That offer stil stands!

Over and above all the other problems that I had with VODACOM who, at the outset and in blatant breach of our contract, simply refused to furnish me with information that I needed to activate programs on my 3G laptop, and thereafter attempting to raid my bank account, three months in a row, with illegal debit orders after I had paid (in cash) the amount that Vodacom told me is due for each month; and furthermore added insult to injury when it illegally locked my account despite the fact that, as Paulina at VODACOM put it, “if I go and check on your statements, there is no amount in arrears”, I also had the problem at the outset that my 500 MEG data bundle disappeared as if in a black hole within days. And soon thereafter a further 1 GIG suffered the same fate. My subsequent experience with another facility appears to be completely at variance with my VODACOM contract data bundle experience. I therefore need to know from VODACOM what evidence it can produce concerning the data that were used on a particular SIM card.

As regards all the problems that I had with VODACOM who, at the outset and in blatant breach of our contract, simply refused to furnish me with information that I needed to activate programs on my 3G laptop, and thereafter attempting to raid my bank account, three months in a row, with illegal debit orders after I had paid (in cash) the amount that Vodacom told me is due for each month, I require the following information concerning each telephone conversation that I had with VODACOM and its agents regarding our contract:(a) The time, date, and duration of the call. (b) The parties involved in the conversation. (c) The note concerning the conversation that was made by VODACOM. I am entitled to the information in terms of the Promotion of Access to Information Act and in an attempt to generate some credibility, VODACOM would be well advised to furnish the information forthwith, and not attempt to adopt a formalistic approach.
